§ 1 Identity of the data controller

  2. The data is processed in accordance with the current legal provisions, i.e. Regulation of the European Parliament and of the EU Council 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95 /46/WE (hereinafter: GDPR), the Act of May 10, 2018 on data protection, as well as the Act of July 18, 2002 on the provision of electronic services.

§ 2 Definitions

The following definitions are used in this Privacy Policy:

  1. Website/Shop – a website available at www.joliconceptstore.com, through which the User can: browse its content, contact the Data Administrator via the contact form, place orders for products and goods, order commercial and marketing information (newsletter ).

  1. Personal data – any information that can lead to the identification of a natural person without excessive time and cost, including their identification, address and contact details.

§ 3 Purposes of data processing

  1. The personal data administrator processes personal data for the following purposes 

a) Performance of the contract to which the data subject is a party or to take action at the request of the data subject, i.e. placing and processing an order in the Online Shop;

b) Implementation of the rights of the person related to the execution of the order, including guarantees and warranties, etc.;

c) Registration and setting up an account on the Website;

d) Documenting the sale or performance of the service, including issuing a bill or invoice for a natural person;

e) Answering the question asked via the contact form or via the contact details available on the Website;

f) Marketing of the Data Administrator's own products and services by traditional means;

g) Sending commercial and marketing information of the Data Administrator to the e-mail address provided by the User when subscribing to the newsletter, with the consent of the data subject;

h) Sending opinions about the Data Administrator's services and products by external satisfaction survey websites, such as Opineo, Ceneo, etc. with the consent of the data subject;

i) Pursuing rights and claims by the Data Administrator or the data subject.

  1. Providing data is necessary for the execution of the order, issuing a sales document, pursuing claims, as well as answering questions.
  1. Providing other data is voluntary.
  1. Failure to provide the required data makes it impossible to perform services, including orders and contact.

§ 4 Data collection

  1. The User's personal data is collected directly from the data subjects by: 

a) Filling out the form with contact details when submitting an inquiry via the form on the website;

b) Completing the newsletter subscription form;

c) Completing the order form in the Online Shop;

d) Registering an account on the Website;

e) Providing data for the preparation and conclusion of the contract;

f) Direct contact with the Data Administrator using the contact details available on the website or in traditional form at the place of business.

§ 5 Scope of processed data

1. The scope of processed personal data has been limited to the minimum necessary to provide services in the field of:

a) Submitting an inquiry via the contact form or using the contact details available on the website: e-mail address, telephone number, e-mail address, name, any other data provided voluntarily by the data subject;

b) Subscribing to the newsletter: name, e-mail address;

c) Placing an order in the Online Shop: name and surname, e-mail address, telephone number, delivery address, possibly the address of the collection point;

d) Account registration on the Website or Online Shop: name and surname, e-mail address, password, login;

e) Issuing a bill or invoice: name and surname or name of the entity, address of the registered office, tax identification number.

§ 6 Data processing period

1. Personal data are processed for the period necessary to achieve the purpose for which they were collected, i.e.:

a) For the duration of the concluded contract;

b) For the period necessary to document the contract or service performed, including issuing a bill or invoice - the data is stored for 5 years, counting from the end of the calendar year in which the tax payment deadline expired;

c) For the period necessary to answer the question asked via the contact form or by phone;

d) Until the consent is revoked, if the data processing is based on the consent of the data subject.

§ 7 Data recipient

  1. The User's personal data may be entrusted to other entities in order to perform services at the request of the Data Administrator, in particular entities in the field of:

a) Website hosting;

b) Service and maintenance of IT systems in which data is processed, including for the purpose of newsletter automation, invoicing, order processing, etc.;

c) Providing accounting services;

d) Providing office services;

e) Courier services broker;

f) Dropshipping and order processing.

  1. The User's personal data may also be made available to entities supporting the Data Administrator, including entities providing courier and postal services, online payment services.
  2. The User's personal data is not transferred to third countries or international organisations.

§ 8 Rights of data subjects

1. The data subject is entitled to:

a) The right to access the content of the data and rectify it;

b) The right to delete data, unless other provisions of law apply that oblige the Data Administrator to archive data for a certain period of time;

c) The right to transfer data, provided that the basis for data processing is the contract or consent of the data subject, and the data processing is automatic;

d) The right to object to the processing of data for direct marketing purposes, carried out by the Data Administrator as part of a justified legal interest, as well as to limit processing;

e) The right not to be subject to automatic profiling, if the Data Administrator would make decisions based solely on automatic profiling and having legal effects for the data subject or similarly affecting them;

f) The right to control data processing and information on who is the Data Administrator, as well as to obtain information about the purpose, scope and method of data processing, the content of this data, the source of data, as well as the method of sharing, including recipients or categories of recipients data;

g) The right to withdraw consent at any time, if the basis for data processing was the consent of the data subject. Withdrawal of consent does not affect the lawfulness of the processing carried out on its basis before its withdrawal;

h) The right to lodge a complaint with the President of the Office for Personal Data Protection (PUODO), if the person considers that the processing of their data is inconsistent with the current regulations in this regard.

§ 9 Cookie notice

1. The shop does not automatically collect any information, except for the information contained in cookie files.

2. Cookie files (so-called "cookies") are IT data, in particular text files, which are stored in the end device of the Shop User and are intended for using the Shop's websites. Cookies usually contain the name of the website they come from, their storage time on the end device and a unique number.

3. The entity placing cookies on the Shop User's end device and accessing them is the Shop operator.

4. Cookies are used to:

a) Adjusting the content of the Shop's websites to the User's preferences and optimising the use of websites; in particular, these files allow to recognise the Shop User's device and properly display the website, tailored to their individual needs;

b) Creating statistics that help to understand how Store Uhop sers use websites, which allows for improving their structure and content.

5. The Shop uses two basic types of cookies: "session" (session cookies) and "permanent" (persistent cookies). Session cookies are temporary files that are stored on the User's end device until they leave the website or turn off the software (web browser). "Permanent" cookies are stored on the User's end device for the time specified in the cookie file parameters or until they are deleted by the User.

6. The Shop uses the following types of cookies

a) "Necessary" cookies, enabling the use of services available within the Shop, e.g. authentication cookies used for services requiring authentication within the Shop;

b) Cookies used to ensure security, for example used to detect fraud in the field of authentication within the Shop;

c) "Performance" cookies, enabling the collection of information on how to use the Shop's websites;

d) "Functional" cookies, enabling "remembering" the settings selected by the User and personalising the User's interface, e.g. in terms of the selected language or region from which the User comes, font size, website appearance, etc.;

e) "Advertising" cookies, enabling the provision of advertising content to Users more tailored to their interests.

§ 10 Final provisions

  1. The Data Administrator reserves the right to change this Privacy Policy, especially if the technical solutions used require it, changes in the law regarding the privacy of data subjects or other significant changes affecting the content of information provided to Users.
  2. In the event of a change in the current Privacy Policy, appropriate modifications to the above provision will be made, which will be effective from the date of their publication on the Website/Shop website.
